MOOVA Run Festival 02 Left Bank (Cardigan Road, LS6 1LJ) Saturday 7th March // 11am-4pm After the huge success of last year's first ever MOOVA Run Festival, we return to the streets of Leeds for our 2nd instalment with even bigger & more exciting things planned including new sponsors, wild trainer try ons, sports massages, delicious food, free drinks & an awesome MOOVA goodie bag! Once again, there will be 3 running distances to choose from and we'll leave from Left Bank in those groups for a MOOVA run experience. Offering 3 distances allows us to cater for a variety of running levels as well as giving people the option to challenge themselves, if they want, in a comfortable & supportive environment. Everyone will be able to take part in fitness instructor led group warm ups and cool downs to ensure no pesky injuries! MOOVA Run Festival will be supported by a whole host of event partners and sponsors which means plenty of freebies, branded giveaways, cool trainer try ons & product tasters throughout the day. And as always, the MOOVA tunes will be pumping throughout the day courtesy of our MOOVA resident DJs. GENERAL In these Terms & Conditions: "MOOVA" means FRESH2DEATH LIMITED, company number 10700149; "Moova Leader" means any individual considered a staff member of MOOVA events; "Moova Captain" means any individual considered a volunteer member of MOOVA events; "Crew Member/Participant" means the individual named on the redeemed ticket through FIXR; "FIXR" means the events platform, owned by VIPR Digital Ltd, used for ticketing MOOVA events; "Agreement" means the acceptance of terms between MOOVA and the Crew Member/Participant under these Terms & Conditions; "Participant Rules" means the rules and policies Crew Members/Participants agree to when attending MOOVA events. 2. REGISTRATION Crew Members/Participants must redeem a ticket and agree to this Agreement via FIXR prior to attending any MOOVA event. If a Crew Member/Participant does not select "yes" to agree to these Terms & Conditions during ticket redemption, they will not be permitted to attend the event. Participation is at MOOVA's absolute discretion and subject to availability. MOOVA reserves the right to charge a participation fee at its discretion. All Crew Members/Participants agree to abide by the Participant Rules. Breach of these rules may result in immediate ejection from an event and/or the wider MOOVA community. 3. CONDUCT MOOVA is committed to creating a welcoming, inclusive environment for all. Offensive or inappropriate behaviour will not be tolerated, including but not limited to: Intimidation Verbal Abuse Physical Violence Harassment (physical, verbal, or sexual) Disrespect towards MOOVA Leaders, Captains, or other participants MOOVA reserves the right to impose penalties for misconduct, including suspension, termination of participation, and permanent bans. Complaints or reports of inappropriate behaviour should be made privately by contacting MOOVA via Instagram direct message or by emailing [email protected]. Please do not post reports in the WhatsApp community group. All Crew Members/Participants must comply with reasonable instructions from MOOVA Leaders related to health, safety, and event operation. MOOVA Leaders are insured and first aid trained. Moova Captains are volunteers only and must be treated with respect. 4. EVENTS MOOVA events, timetables, routes, Leaders, and Captains are subject to change at any time. We will endeavour to provide notice when an event cannot proceed. Ticket redemption is required in advance to secure a place, as events have limited capacity. 5. HEALTH AND SAFETY Crew Members/Participants take full responsibility for their own health and safety during MOOVA events, including any pre-existing conditions. MOOVA Leaders hold basic first aid training but are not medically qualified to assess a participant’s fitness to participate. Participants are advised to seek medical advice before participating if unsure. 6. RISK Necessary risk assessments have been undertaken and events are deemed sufficiently safe. However, MOOVA assumes no liability for participant actions or injuries during events. Participation is at the individual's own risk. 7. AGE Only those aged 18 or over may participate in MOOVA events. Proof of ID may be required if age is in doubt. 8. BAG DROP AND LOST PROPERTY Bag drop services may be offered at certain events but are used entirely at the participant's own risk. MOOVA accepts no responsibility for any loss, theft, or damage to items brought to events, including those left at partner venues. 9. PHOTOS & CONTENT Photos and videos may be captured at events and used for MOOVA marketing, social media, or promotional purposes by MOOVA, its affiliates, sponsors, or partners. By attending, participants consent to this usage without further approval. 10. LIMITATION OF LIABILITY Nothing in these Terms & Conditions limits MOOVA’s liability for: Death or personal injury caused by its negligence Fraud or fraudulent misrepresentation Any liability that cannot legally be excluded Subject to this: MOOVA and its affiliates, sponsors, and partners shall not be liable for any indirect, incidental, or consequential loss arising under or in connection with participation; MOOVA’s total liability per participant shall be limited to £100. 11. PERSONAL INFORMATION Crew Members/Participants are responsible for keeping their personal details up to date. MOOVA takes data protection seriously and will only contact Crew Members/Participants regarding MOOVA events, services, or related communications. 12. CHANGES TO TERMS & CONDITIONS MOOVA reserves the right to update these Terms & Conditions at any time. Participants will be notified via WhatsApp and/or FIXR. Changes are effective immediately once posted. 13. BINDING AGREEMENT This Agreement (consisting of the FIXR ticket application, these Terms & Conditions, and the Participant Rules) forms the complete agreement between MOOVA and the Crew Member/Participant. Failure by MOOVA to enforce any right does not constitute a waiver of that right. 14. GOVERNING LAW These Terms & Conditions are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising in connection with them.
