We're here to provide you with mega fun, welcoming events that encourage you to get out, meet friends & get more from your years in Exeter! ​If you have any questions prior to our events, or for opportunities to get further involved with the brand, please message an admin in the MAAX Exeter Whatsapp chat (or Sonny on +447427262317). ​To the MAAX! ______________________________ Hardest Adventures Terms & Conditions Part A — Definitions & Registration A.1 General In these Terms & Conditions: "MAAX" means Hardest Travel Group, trading as Hardest Adventures ("we", "our", "us"), company number 16134869; "MAAX Leader" means any individual considered a staff member at MAAX events; "MAAX Captain" means any individual considered a volunteer member at MAAX events; "Crew Member/Participant" means the individual named on the redeemed ticket through FIXR; "FIXR" means the events platform used for registering attendance at MAAX events; "Agreement" means the acceptance of terms between MAAX and the Crew Member/Participant under these Terms & Conditions; "Participant Rules" means the rules and policies Crew Members/Participants agree to when attending MAAX events. A.2 Registration Crew Members/Participants must register via FIXR and agree to this Agreement prior to attending any MAAX event. If a Crew Member/Participant does not agree to these Terms & Conditions during registration, they will not be permitted to attend the event. Participation is at HA's absolute discretion and subject to availability. MAAX reserves the right to charge a participation fee at its discretion. All Crew Members/Participants agree to abide by the Participant Rules. Breach of these rules may result in immediate ejection from an event and/or the wider MAAX community. Part B — Taking Part in MAAX Events B.1 Age Only those aged 18 or over may participate in MAAX events. Proof of ID may be required if age is in doubt. B.2 Events MAAX events, timetables, routes, Leaders, and Captains are subject to change at any time. We will endeavour to provide notice when an event cannot proceed. Registration via FIXR is required in advance to secure a place, as events have limited capacity. B.3 Conduct MAAX is committed to creating a welcoming, inclusive environment for all. Offensive or inappropriate behaviour will not be tolerated, including but not limited to: Intimidation Verbal Abuse Physical Violence Harassment (physical, verbal, or sexual) Disrespect towards MAAX Leaders, Captains, or other participants MAAX reserves the right to impose penalties for misconduct, including suspension, termination of participation, and permanent bans. Complaints or reports of inappropriate behaviour should be made privately by contacting MAAX via Instagram direct message or by emailing [email protected]. Please do not post reports in any public community group or channel. All Crew Members/Participants must comply with reasonable instructions from MAAX Leaders related to health, safety, and event operation. MAAX Leaders are insured. MAAX Captains are volunteers only and must be treated with respect. B.4 Health and Safety Crew Members/Participants take full responsibility for their own health and safety during MAAX events, including any pre-existing conditions. MAAX Leaders are not medically qualified to assess a participant's fitness to participate. Participants are advised to seek medical advice before participating if unsure. B.5 Risk Necessary risk assessments have been undertaken and events are deemed sufficiently safe. However, MAAX assumes no liability for participant actions or injuries during events. Participation is at the individual's own risk. B.6 Personal Belongings MAAX does not offer a bag drop service at events. Participants bring personal belongings entirely at their own risk. MAAX accepts no responsibility for any loss, theft, or damage to items brought to events, including those left at partner venues. Part C — Your Data & Our Content C.1 Personal Information Crew Members/Participants are responsible for keeping their personal details up to date. MAAX takes data protection seriously and will only contact Crew Members/Participants regarding MAAX events, services, or related communications. MAAX may also use your contact details to send you marketing about MAAX events, offers, and related content. You can opt out of these communications at any time by emailing [email protected] C.2 Photos & Content Photos and videos may be captured at events and used for MAAX marketing, social media, or promotional purposes by MAAX, its affiliates, sponsors, or partners. By attending, participants consent to this usage without further approval. Part D — Legal Terms D.1 Limitation of Liability Nothing in these Terms & Conditions limits MAAX's liability for: Death or personal injury caused by its negligence Fraud or fraudulent misrepresentation Any liability that cannot legally be excluded Subject to this: MAAX and its affiliates, sponsors, and partners shall not be liable for any indirect, incidental, or consequential loss arising under or in connection with participation; MAAX's total liability per participant shall be limited to £100. D.2 Changes to Terms & Conditions MAAX reserves the right to update these Terms & Conditions at any time. Participants will be notified via FIXR and/or MAAX's community channels. Changes are effective immediately once posted. D.3 Binding Agreement This Agreement (consisting of the FIXR registration, these Terms & Conditions, and the Participant Rules) forms the complete agreement between MAAX and the Crew Member/Participant. Failure by MAAX to enforce any right does not constitute a waiver of that right. D.4 Governing Law These Terms & Conditions are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising in connection with them.
