Hardest Adventures Terms & Conditions: Student-Led Hikes
Part A — Definitions & Registration
A.1 General - In these Terms & Conditions: “HA” means Hardest Travel Group, trading as Hardest Adventures (“we”, “our”, “us”), company number 16134869; “HA Leader” means any individual considered a staff member at HA events; “HA Student Leader” means a student volunteer appointed by HA to organise and lead a hike on HA’s behalf; “Crew Member/Participant” means the individual named on the redeemed ticket through FIXR; “FIXR” means the events platform used for registering attendance at HA events; “Hike” means any walking or hiking event organised under the HA name, including travel between meeting points and trailheads where arranged by HA; “Agreement” means the acceptance of terms between HA and the Crew Member/Participant under these Terms & Conditions; “Participant Rules” means the rules and policies Crew Members/Participants agree to when attending HA events.
A.2 Registration - Crew Members/Participants must register via FIXR and agree to this Agreement before attending any Hike. If a Crew Member/Participant does not agree to these Terms & Conditions during registration, they will not be permitted to attend. Participation is at HA’s absolute discretion and subject to availability. HA reserves the right to charge a participation fee at its discretion. All Crew Members/Participants agree to abide by the Participant Rules. Breach of these rules may result in immediate removal from a Hike and/or the wider HA community.
Part B — Taking Part in HA Hikes
B.1 Age - Only those aged 18 or over may take part in HA Hikes. Proof of ID may be required if age is in doubt.
B.2 The Hike Leader - Each Hike is led by an HA Student Leader. HA Student Leaders are volunteers. They are not professional mountain leaders or qualified guides, and they are not first aid trained or medically qualified. Their role is to organise the Hike, set the pace, keep the group together and make decisions about the route and conditions on the day. Participants must follow all reasonable instructions from the HA Student Leader relating to safety, route and timing. HA Student Leaders must be treated with respect.
B.3 Hikes & Changes - Routes, distances, timings, meeting points and leaders are subject to change at any time. HA or the HA Student Leader may shorten, reroute, postpone or cancel a Hike, including on the day or partway through, due to weather, ground conditions, daylight, group pace or any other safety concern. We will endeavour to give notice where possible. Registration via FIXR is required in advance, as Hikes have limited capacity.
B.4 Fitness & Suitability - Each Hike will state its expected distance, duration and difficulty. Participants are responsible for judging whether they are fit and able to complete the Hike at the advertised level. Participants should share any medical condition, allergy or medication that could affect them on the day with the HA Student Leader before setting off; this will be kept confidential. If unsure about your fitness to take part, seek medical advice first.
B.5 Kit & Equipment - Participants must bring suitable kit for the Hike and the forecast conditions, including as a minimum: appropriate footwear with grip, waterproof jacket, warm layers, enough water and food for the full Hike, and a charged mobile phone. Any additional kit listed on the event page is also required. The HA Student Leader may refuse to let anyone start who is not adequately equipped, and no refund will be due in that case.
B.6 On the Hike Participants must:
Stay with the group and not go ahead of the leader or fall behind the back marker
Tell the HA Student Leader before leaving the group for any reason, including leaving the Hike early
Stay on the planned route and follow the Countryside Code, including respecting private land, livestock and gates, and taking all litter home
Not consume alcohol or illegal drugs before or during the Hike
Anyone who leaves the group or the route without telling the HA Student Leader does so entirely at their own risk.
B.7 Emergencies - In an emergency, call 999 and ask for the police, then Mountain Rescue if in upland or remote terrain, and inform the HA Student Leader. Participants should save HA’s emergency contact, +44 7427 262317, before the Hike.
B.8 Travel - Unless stated on the event page, participants are responsible for their own travel to and from the meeting point. HA’s responsibility ends when the Hike finishes at the stated end point.
B.9 Conduct - HA is committed to creating a welcoming, inclusive environment for all. Offensive or inappropriate behaviour will not be tolerated, including but not limited to:
Intimidation
Verbal abuse
Physical violence
Harassment (physical, verbal or sexual)
Disrespect towards HA Student Leaders, HA Leaders or other participants
HA reserves the right to impose penalties for misconduct, including suspension, termination of participation and permanent bans. Complaints or reports of inappropriate behaviour, including about an HA Student Leader, should be made privately by Instagram direct message or by emailing [email protected]. Please do not post reports in any public community group or channel.
B.10 Health and Safety - Crew Members/Participants take full responsibility for their own health and safety during HA Hikes, including any pre-existing conditions.
B.11 Risk - Hiking carries inherent risks, including slips, trips and falls, uneven and steep ground, changeable weather, cold and heat, water crossings, livestock and remoteness from help. Necessary risk assessments have been undertaken and Hikes are deemed sufficiently safe. However, participation is at the individual’s own risk, and HA assumes no liability for participant actions or injuries during Hikes, subject to Part D.
B.12 Personal Belongings - Participants bring personal belongings entirely at their own risk. HA accepts no responsibility for any loss, theft or damage to items brought on Hikes.
Part C — Your Data & Our Content
C.1 Personal Information - Crew Members/Participants are responsible for keeping their personal details up to date. HA takes data protection seriously and will only contact Crew Members/Participants regarding HA events, services or related communications. HA may also use your contact details to send you marketing about HA events, offers and related content. You can opt out at any time by emailing [email protected]. Any medical information shared with an HA Student Leader will be used only for your safety on the Hike.
C.2 Photos & Content - Photos and videos may be captured on Hikes, including by HA Student Leaders, and used for HA marketing, social media or promotional purposes by HA, its affiliates, sponsors or partners. By attending, participants consent to this usage without further approval.
Part D — Legal Terms
D.1 Limitation of Liability - Nothing in these Terms & Conditions limits HA’s liability for:
Death or personal injury caused by its negligence
Fraud or fraudulent misrepresentation
Any liability that cannot legally be excluded
Subject to this: HA and its affiliates, sponsors and partners shall not be liable for any indirect, incidental or consequential loss arising under or in connection with participation; HA’s total liability per participant shall be limited to £100.
D.2 Changes to Terms & Conditions - HA reserves the right to update these Terms & Conditions at any time. Participants will be notified via FIXR and/or HA’s community channels. Changes are effective immediately once posted.
D.3 Binding Agreement - This Agreement (consisting of the FIXR registration, these Terms & Conditions and the Participant Rules) forms the complete agreement between HA and the Crew Member/Participant. Failure by HA to enforce any right does not constitute a waiver of that right.
D.4 Governing Law - These Terms & Conditions are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising in connection with them.
